What is copyright? How to register copyright?
Copyright is a legal term used to describe the rights that authors have over their literary and artistic works. Works covered by copyright range from books, music, paintings, sculptures and films, computer programs, databases, advertisements, maps and technical drawings.
In Vietnam, copyright is regulated in detail in the 2005 Civil Code (now replaced in the 2015 Civil Code), the Intellectual Property Law and the Government's Decree No.22/2018/ND-CP on regulating details and guide the implementation of a number of articles of the Civil Code Intellectual Property Law on copyright and related rights.
Types of protected copyright
Base on Article 14 of the Intellectual Property Law, protected literary, artistic and scientific works include:
Literary and scientific works, textbooks, books and other works expressed in writing or other characters; Lectures, speeches and other speeches; Press works; Musical works; Theater works; Cinematographic works and works created by a similar method (hereinafter referred to as cinematographic works); Visual and applied art works; Photographic works; Architectural works; Maps, diagrams, maps, drawings related to topography, scientific works; Literary and folk art works; Computer program, data collection.
Article 14 also stipulates: Derivative works (A derivative work is a work translated from one language into another language, an adapted, compiled, annotated, selected work) only protection under the provisions of point a if it does not prejudice the copyright of the work used to make a derivative work.
In addition, literary and scientific works, textbooks, books, other works expressed in writing or other characters and lectures, speeches and other speeches must be created directly by the author's intellectual labor without copying from the work of others.
