Intellectual property: An important factor determines the competitiveness of enterprises

Speaking at the workshop "Law amending and supplementing a number of articles of the Intellectual Property Law - Matters need attention" that just took place, Mr. Nguyen Van Bay, Deputy Director of the NOIP said that the IP Law was approved by the National Assembly in 2005, amended and supplemented in 2009 and 2019, is an important legal document that regulates social relations related to a special type of property - intellectual property.
Through 16 years of practice, the IP Law has played a great role in creating a legal corridor on IP, promoting the country's socio-economic development. However, in the new context, practical implementation along with Vietnam's extensive international integration shows that the IP Law still has certain obstacles and inadequacies. Therefore, the IP Law has been proposed to be revised to institutionalize the guidelines and lines of the Party and the State's policies, overcome practical obstacles and inadequacies, and internalize commitments to be in line with the international practice law.
On June 16, 2022, at the 3rd session, the XV National Assembly voted to approve the Law amending and supplementing a number of articles of the Intellectual Property Law (Law No. January 1, 2023. Law amending and supplementing 102 articles of the Intellectual Property Law (of which 88 articles are amended and supplemented, 14 new articles are added) and 2 articles are annulled, and at the same time amending and supplementing a number of articles of other related laws.
According to Mr. Nguyen Van Bay, in addition to propagating and disseminating relevant groups of subjects, NOIP is developing and submitting to competent authorities for promulgation documents guiding the implementation of the Law according to the plan, which is the immediate amending a number of Government decrees, such as Decree No. 103/2006/ND-CP on industrial property, Decree No. 105/2006/ND-CP on state management and protection of intellectual property rights.
According to the Department of Legal and Policy (NOIP), the amendment content of the IP Law focuses on 7 major groups of policies, such as Ensuring clear regulations on authors, copyright holders, performers, and owners of related rights in cases of assignment or transfer of copyright or copyright-related rights; encourage the creation, exploitation and dissemination of inventions, industrial designs, layout designs and plant varieties created from scientific and technological tasks using the State budget; facilitate the process of carrying out procedures for copyright registration, procedures for establishing industrial property rights...
