Decree No. 142: Many new favorable points for radiation work
Decree No. 142/2020/ND-CP stipulating the conduct of radiation work and supporting service activities for atomic energy application was promulgated by the Prime Minister on December 9, 2020 and it was effective from February 1, 2021.

Decree No.142 cuts administrative procedures, creates favorable conditions for businesses, organizations and individuals to participate in various types of radiation work and activities to support the application of atomic energy, Mr. Nguyen Tuan Hai - Director of the Department of Radiation Safety, said at the Conference on dissemination of the Decree in Ho Chi Minh City on January 14.

Decree No.142 has many new points, reducing administrative procedures for establishments, including stipulating a number of jobs that do not require permits, such as radiation equipment, radioactive sources exempted from declaration, and granting permits according to regulations of the national technical standard QCVN 5:2010/BKHCN on Radiation Safety; using consumer goods that have been irradiated or containing radioactive substances and etc. Establishments that do not need a construction permit are those operating irradiation equipment with self-shielding structures designed by the manufacturer; Accelerator operators use mobile phones to screen and inspect goods.

According to Mr. Dinh Ngoc Quang, Head of the Department of Legal and Policy of the Department of Radiation Safety, Decree No.142 consists of 5 chapters with 63 articles. Decree stipulates conditions, dossiers, order and procedures for granting licenses to conduct radiation work, registration certificates for atomic energy application support services and certificates of atomic energy application support service practices. In addition, there are procedures, such as approval of grassroots incident response plans and certification of radiation workers.

In addition, the Decree has shortened the time for appraisal and granting all kinds of permits from 5 to 30 days compared to before, while the time for submission of dossiers has been extended later than the old regulations, specifically: 15 days for import and export permits, 45 days for other permits. Processing time for the extension is also faster (15 days for import and export licenses, 25 days for licenses to use medical diagnostic X-ray equipment, 30 days for other licenses).

In addition, according to the Decree, most establishments will not need to submit to the agency managing the incident response plan for approval; radiation worker certificate (in charge of safety, incident response) will be indefinite; allowing establishments to combine all licenses into a single license; expand the scope of licensed content; and etc.
