The National Assembly Standing Committee gives opinions on the draft Law amending and supplementing a number of articles of the Intellectual Property Law
The acquisition, revision and completion of the draft Law on amending and supplementing a number of articles of the Intellectual Property Law has been and carefully conducted on the basis of comprehensive consideration and assessment of the impact of the policy, follow up and promptly meet the requirements of practice.

The draft Law on amending and supplementing a number of articles of the Intellectual Property Law was considered and commented on by the Standing Committee of the National Assembly at the 8th meeting held in the afternoon of February 15.
Previously, at the 2nd session (October 2021), the National Assembly discussed and commented on the draft on Law amending and supplementing a number of articles of the Intellectual Property Law. Immediately after the meeting, following the direction of the National Assembly Standing Committee, the Standing Committee of the Law Committee chaired and coordinated with the drafting agency and relevant agencies to synthesize and study the opinions of the representatives of the National Assembly to the National Assembly to receive, revise and perfect the draft Law; organize working sessions and surveys at a number of relevant agencies and organizations; organize workshops, consult experts, scientists, managers, subjects directly affected to have more theoretical and practical basis for completing the draft Law; organize meetings of the Standing Law Committee with relevant ministries and branches to discuss and agree on a number of major issues of the draft Law.
Reporting on a number of major issues on the interpretation, absorption and revision of the draft Law on amending and supplementing a number of articles of the Intellectual Property Law, Chairman of the Law Committee Hoang Thanh Tung said, Standing Law Committee found that this is a difficult and specialized law project; the reception, revision and completion of the draft Law has been carefully conducted on the basis of comprehensive consideration and assessment of the impact of the policy, closely followed and promptly met the requirements of reality.
Issues that are ripe, clear, proven in practice, and highly consistent are specified in the Law; new issues, which have not been tested or need to be flexibly adjusted to suit the requirements of socio-economic development in each period, the Law defines a number of general principles for assigning detail regulations.
In that spirit, after absorbing, revising, and drafting the Law amending and supplementing 102 articles of the Intellectual Property Law (an increase of 11 articles compared to the draft Law submitted to the National Assembly at the 2nd session), there are 12 articles amending and supplementing techniques, abolishing a number of provisions in 5 articles. Basically, the received and revised content has reached consensus and agreement between the agency in charge of verification and the agency in charge of drafting the law.
Specifically, agreeing on the scope of regulation, the name of the Law, the plan to absorb and adjust for two major issues, the Government consulted the National Assembly at the 2nd session (on the assignment of patent registration rights, industrial designs, layout designs that are the results of scientific and technological tasks funded by the State budget; administrative sanctions for acts of infringing upon intellectual property rights).
Unified explanation, acceptance and adjustment of regulations on major groups of issues in the draft Law, including 14 contents for issues of copyright and related rights, 19 contents for group of issues on industrial property, 2 contents for the group of issues of rights to plant varieties, 4 contents for the group of issues of protection of intellectual property rights.
Agree to amend and supplement a number of articles of the Law on Prices, the Law on Customs, the Law on Science and Technology, and the Law on Management and Use of Public Property to ensure the consistency and synchronism of the legal system.
In addition to the above major contents, the Standing Committee of the Law Committee has received opinions of the National Assembly deputies, reviewed and adjusted to complete the draft Law in terms of both content and technical documents. These contents are fully and specifically reported in the draft Report on explanation, absorption and correction of the draft Law on amending and supplementing a number of articles of the Intellectual Property Law and the draft Law.
Discussing at the meeting, members of the National Assembly Standing Committee said that the draft Law has been completed on the basis of absorbing and explaining quite fully and in detail the opinions of the National Assembly deputies, reaching the approval of the National Assembly deputies, high consensus of the lead agency, verification agency, relevant agencies. The added issues show thoroughness, in the process of working with experts, scientists, managers, and subjects directly affected to have more theoretical and practical basis.
